New York man dies after chokehold by police By Deborah E. Bloom and Jareen Imam, CNN Updated 5:31 PM ET, Mon December 8, 2014
In this article they talk about a man named Eric Garner. He had resisted arrest, got choked out, and died from cardiac arrest on the way to the hospital. His family and friends protest due to the lose of a loved one by a police officer in a sticky situation. The video provided is very violent. Its of a man resisting arrest getting put into a choke hold yelling that he can’t breath then going motionless. No matter what many people are un happy to see a life go like that. It is very sad that this man had to lose his life like that and I am very aware why there are so many people upset. But the question I would like to focus on is, was this an act of police brutality? This article talks about how no one should have to lose a loved one like this and, how sad this is, and I one hundred and ten percent agree. However was the cop wrong for doing his job and arresting a man that was not only breaking the law in the moment but also held a criminal history and was refusing to corporate. Many people look at this as he was saying he couldn’t breath, and he was harmless, however if he corporate in the beginning would this act have taken place? Would he still be walking the streets today and being able to be with his loved ones. In no way shape or form am I agreeing with the lose of this mans life, the point I’m trying to make is that I don’t believe that the cop was wrong for doing his job, I don’t believe he had the intension to end this mans life, but it wouldn’t be justice if he let him walk away from the scene.
What Procedures Must the Police Follow While Making an Arrest? http://criminal.findlaw.com/criminal-procedure/what-procedures-must-the-police-follow-while-making-an-arrest.html
“One universal rule police officers must follow is that they are not allowed to use excessive force or treat the arrestee cruelly. Generally, police officers are only allowed to use the minimum amount of force necessary to protect themselves and bring the suspect into police custody. This is why people are advised to never resist an arrest or argue with police. The more a suspect struggles, the more force is required for the police to do their job.”
Like it says in the text above once the suspect starts to struggle the more force is required for the police to do their job. In my opinion this is a perfect example of what took place in this video. The man resisted arrest so he got put in a choke hold, he was squirming so the force became stronger, finally when he couldn’t breath and was begging for help the police could no longer do him any justice.
